When you register for an account or contact us, we collect:
Through your authorized connection to your energy management system (EMS), we collect minute-level operational data from your rooftop HVAC units (RTUs), including:
This data is transmitted from your EMS provider to our servers via secure API connection. You authorize this data collection by connecting your EMS account to the Platform.

We collect outdoor air temperature data from OpenWeatherMap for your site locations to normalize equipment performance analysis. This data is associated with your location coordinates but does not include personally identifiable information.

We use aggregated, anonymized data derived from all clients to train and improve our machine learning anomaly detection models, develop industry benchmarks for HVAC performance, improve features and user experience, and conduct internal research. Aggregated data does not identify your specific organization, locations, or equipment.
We may use your contact information to send transactional communications (invoices, account notices, service alerts), provide technical support, send product updates and new feature announcements (you may opt out at any time), and respond to your inquiries.
We may use your information to comply with applicable laws, respond to legal process, enforce our Terms of Service, and protect the rights and safety of EEM, our clients, and the public.
Equipment data is stored in our cloud database (Supabase PostgreSQL, hosted on AWS). We maintain a rolling 21-day window of data in our primary cloud database. Data older than 21 days is archived to our secure on-premises server for long-term retention. Backups are performed daily to encrypted cloud storage.

While we implement these measures, no security system is impenetrable. In the event of a data breach that affects your data, we will notify you as required by applicable law.
We retain your account and Client Equipment Data for the duration of your subscription and for thirty (30) days following termination, during which you may request a data export. After that period, Client Equipment Data is deleted. Aggregated, anonymized Platform Intelligence derived from your data is retained indefinitely as part of our machine learning models and industry benchmarks.
EEM does not sell, rent, or trade your Client Equipment Data or personal information to third parties for their marketing purposes.
We share data with trusted third-party service providers who assist in operating the Platform, subject to confidentiality agreements and solely for the purpose of providing services to EEM:

To provide the Platform's core functionality, we connect to your authorized EMS provider (e.g., eViewIoT). We transmit only necessary authentication and query information to your EMS provider to retrieve equipment data on your behalf. We do not share your equipment data back to EMS providers for their independent use.
We may disclose information if required by law, court order, or government authority, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of EEM, our clients, or the public.
In the event of a merger, acquisition, or sale of EEM's assets, your data may be transferred to the acquiring party. We will provide notice before your data is subject to a materially different privacy policy.
You may access, review, and update your account information at any time through the Platform settings or by contacting us at privacy@eliteenergymanagement.com.
Upon request, EEM will provide you with an export of your Client Equipment Data in a standard machine-readable format within thirty (30) days of your request, provided your account is in good standing or within thirty (30) days of termination.
You may request deletion of your account and associated Client Equipment Data. We will process such requests within thirty (30) days, subject to legal retention obligations and our right to retain aggregated, anonymized data.
You may opt out of non-transactional marketing communications at any time by clicking the "unsubscribe" link in any marketing email or by contacting us. You may not opt out of transactional communications necessary for the operation of your account.
The Platform uses session cookies for authentication and functional purposes. We do not use third-party advertising cookies. Browser settings may be used to manage or disable cookies, though this may affect Platform functionality.
The Platform includes AI-powered diagnostic features ("Ask EEM") powered by Anthropic's Claude language model. When you use Ask EEM, your query and relevant equipment context from your sites are transmitted to Anthropic's API to generate a response. EEM does not permanently store the full content of diagnostic conversations beyond your active session. Anthropic's use of transmitted data is governed by Anthropic's Privacy Policy and API usage terms. Do not submit personally identifiable information about individuals through Ask EEM queries.
The Platform is intended solely for use by business professionals and commercial operators. EEM does not knowingly collect any information from individuals under the age of 18. If we learn that we have inadvertently collected such information, we will promptly delete it.
If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete personal information, and the right to opt out of the sale of personal information. As noted above, EEM does not sell personal information. To exercise your CCPA rights, please contact us at privacy@eliteenergymanagement.com. We will not discriminate against you for exercising your privacy rights.
The Platform operates on infrastructure located primarily in the United States. If you access the Platform from outside the United States, your data will be transferred to and processed in the US. By using the Platform, you consent to this transfer. If you are subject to GDPR or similar international privacy regulations, please contact us at privacy@eliteenergymanagement.com to discuss appropriate data transfer mechanisms.
We may update this Privacy Policy from time to time. We will notify you of material changes via email or in-platform notification at least thirty (30) days before the change takes effect. The "Effective Date" at the top of this document indicates when the current version was last revised. Continued use of the Platform after the effective date constitutes acceptance of the updated policy.
